Amendments to the EAEU technical regulation on perfumery and cosmetic products (CU TR 009/2011) took effect on 28 October 2026. They add 14 substances to the banned list and revise the limits for UV filters, preservatives, fluoride oral care and hair dyes. A stricter formaldehyde labelling threshold follows on 1 January 2027.
The amendments were adopted by EEC Council Decision No. 74 of 12 September 2025. They update the lists of banned and restricted substances, colourants, preservatives and UV filters.
The main changes:
- 14 substances added to the list of banned substances, mostly pesticide actives and industrial chemicals, including the solvent MIBK (4-methylpentan-2-one).
- Fluoride oral care: liquid products with fluoride must not be used for children under 6; new mandatory warnings for toothpastes with 0.1–0.15% fluoride and for products with 0.15–0.5%.
- Oxidative hair and eyelash dyes (p-phenylenediamine, toluene-2,5-diamine, resorcinol and related substances): revised limits and on-pack warnings, including the "black henna" warning and the age limit of 16.
- New restricted substances: methyl salicylate (limits by product type), BHT, methyl N-methylanthranilate and Acid Yellow 3.
- UV filters: revised limits for homosalate (7.34%, face products only, not propellant sprays), benzophenone-3 and octocrylene; a new permitted filter, Bis-(Diethylaminohydroxybenzoyl Benzoyl) Piperazine, including its nano form, up to 10%.
- Titanium dioxide powder with 1% or more respirable particles is restricted as a colourant.
- From 1 January 2027, the warning "releases formaldehyde" is required when the maximum theoretical concentration of released formaldehyde exceeds 0.001% (10 ppm). Today the threshold is 0.05%.
Transition rules are set by EEC Board Decision No. 31 of 10 March 2026:
- Declarations adopted and registration certificates issued before 28 October 2026 remain valid until they expire.
- Products may be manufactured and placed on the market under these documents until they expire. Products already placed on the market may be sold until the end of their shelf life.
- Registration certificates issued before 24 December 2025 follow the earlier transition rules of Decision No. 24 of 4 March 2025.
What this means for manufacturers and importers:
- Check formulas against the new lists before you renew a declaration or registration certificate. New documents must meet the amended requirements.
- Review preservatives that release formaldehyde and plan label changes before 1 January 2027.
- Check labels of fluoride oral care products and oxidative hair dyes.
